Mukesh Gupta Versus State Of Chhattisgarh


लगातार अपमानजनक खबरों के संदर्भ में आईपीएस अधिकारी मुकेश गुप्ता की याचिका पर हाईकोर्ट ने महत्वपूर्ण फैसला दिया है। जस्टिस प्रशांत मिश्रा की एकलपीठ ने जारी अपने आदेश में कहा है कि ऐसे किसी समाचार का प्रकाशन नहीं करें, जिसमें याचिकाकर्ता की निजता का हनन होता है। प्रदेश के एण्टी करप्शन ब्यूराे के एडीजी मुकेश गुप्ता बनाम छत्तीसगढ़ शासन व अन्य के परिवाद पर हाईकोर्ट ने ऐतिहासिक फैसला सुनाया है। हाईकोर्ट के समक्ष याचिकाकर्ता की ओर से बताया गया है कि एक पत्रिका में उनकी निजता संबंधी समाचार का लगातार प्रकाशन किया जा रहा है। साथ ही पत्रिका के मालिक व रिपोर्टर उन्हें इससे भी ज्यादा भद्दे समाचार के प्रकाशन की धमकी दे रहे हैं। इससे उनकी निजता के 8शेष पेज 07 पर अधिकार का हनन हो रहा है। इस मामले में श्री गुप्ता की ओर से पत्रिका के प्रकाशक को नोटिस भी दिया गया था, लेकिन 5 दिसंबर को मियाद समाप्त होने के बाद भी जवाब नहीं दिया गया। तब उन्होंने अदालत का सहारा लिया। एक घंटे से ज्यादा चली सुनवाई के दौरान श्री गुप्ता की ओर से देश के ख्याति प्राप्त वकील महेश जेठमलानी, राजीव श्रीवास्तव, मलय श्रीवास्तव व चित्रया पवार ने पक्ष रखा। वहीं सरकार की आेर से आशुतोष कछवाहा ने पक्ष रखा। अदालत में बताया गया कि निजता के हनन के कुछ मामले में दिल्ली हाईकोर्ट भी रोक लगा चुका है। इसके बाद जस्टिस प्रशांत मिश्रा की एकलपीठ ने याचिकाकर्ता मुकेश गुप्ता की निजता संबंधी समाचार के प्रकाशन पर आगामी आदेश तक के लिए रोक लगा दी है। साथ ही नोटिस जारी कर पत्रिका के स्वामी से 8 सप्ताह के भीतर जवाब-तलब किया है।

Petitioner is a senior officer in the Department of Home, Government of Chhattisgarh. This writ petition has been preferred for a direction to restrain the respondents, particularly the respondent Nos.2 & 3 from publishing any article offending the petitioner by making personal allegations invading his right to privacy guaranteed under Article 21 of the Constitution of India and the right of privacy of his daughter, aged about 16 years, as well. Referring to the judgment of the Supreme Court in the matter of Binny Limited and Another Vs. V. Sadasivan and Others {(2005) 6 SCC 657} and the judgment of Delhi High Court in the matter of ABC vs Commissioner of Police and others {WPC No.12730/2005, decided on 5.2.2013} and that of the judgment of the Supreme Court of United Kingdom in the matter of PJS vs News Group Newspapers Limited, [2016] UKSC 26, Shri Jethmalani, learned Senior counsel would argue that respondent No.3 receives financial assistance from the Government to carry out her media operations by publishing monthly magazine 'Jagat Vision', therefore, she owes a public duty to publish truthful or correct publication to discharge the public function. If a publisher like the respondent Nos.2 & 3 publishes any scurrilous or defamatory article invading any individual's private life, it can no longer be provided financial assistance.

Shri Jethmalani would further argue that under the United Nations Convention to the rights of child, the paramount object of all public action should be to protect the right of children, therefore, any future publication by the magazine, of which the respondent No.3 is the publisher, will offend the petitioner's right under Article 21 of the Constitution of India as well as the right of privacy of his daughter.
Having heard Shri Jethmalani at length and upon perusal of papers and the judgments, I am convinced that respondent Nos.2 & 3 are discharging the public function, therefore, they owe a public duty to publish only true and correct facts in any news or article in relation to any individual or organization, but not to publish any scurrilous or defamatory article.
Issue notice to the respondents.
Shri Kachhawaha, learned Additional Advocate General would accept notice for respondent No.1.
Process fee for service of notice be paid for respondent Nos.2 & 3 only.
Notices be made returnable within 8 weeks.
In the meanwhile, respondent Nos.2 & 3 are restrained from publishing any unsubstantiated, scurrilous or defamatory article in printed or electronic form concerning the petitioner, which may tend to invade his right to privacy or the privacy of his daughter.
